Website Terms

Version 2.0 · Effective September 30, 2026

These Website Terms cover neondeerdata.com, its public content, and browser-based tools, except where separate terms are identified. The website is operated by Neon Deer Data Labs Inc., a Washington corporation (“we”, “us”).

The Platform Terms separately govern the Neon Deer platform and its associated apps. Consulting and other professional services are governed by the applicable Professional Services Agreement or Statement of Work. These Website Terms do not amend those agreements or govern services supplied under them.

Using the website

Users may use the website and its tools for lawful personal or internal business purposes. Users must not interfere with the website, bypass access restrictions, introduce malicious code, impersonate others, or access information without authorization. We may restrict access to prevent abuse or protect the website and its users.

Ordinary search indexing and linking are permitted. Automated access must respect published access restrictions and must not disrupt the website or evade technical controls.

Content and tools

We or our licensors own the website content. Users may view, download, and internally share materials for the permitted purposes above, keeping attribution and proprietary notices. Users may not sell or republish substantial portions without permission, except as permitted by law or an applicable license. Third-party names and trademarks belong to their owners; their appearance does not imply endorsement. Any separate software or content license controls use of the material it covers.

Articles, examples, calculators, and other public tools provide general information and estimates. Results depend on their inputs and assumptions and may become outdated. Users should verify results before relying on them for business decisions or making changes to their systems. Website content does not create a consulting engagement or a commitment to deliver a particular result or feature.

Third-party links and embedded services do not, by themselves, imply our endorsement. Their operators control their services and applicable terms.

Privacy and submissions

Our Privacy Policy explains how we handle personal information. These Terms do not replace any consent required by privacy law.

Users may submit only information they are authorized to provide. Public forms must not be used to send passwords, access tokens, health information, or personal data about anyone under 18. Customers should arrange an appropriate channel with Neon Deer before sharing confidential project materials. Submitting an inquiry does not itself establish a professional services engagement.

Availability and warranties

To the maximum extent permitted by law, the website, content, and public tools are provided “as is” and “as available”, without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee accuracy, uninterrupted availability, or error-free operation. We may change or discontinue website content and tools, subject to any separate agreement that applies.

Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, lost profits, or costs of recovering, restoring, or reconstructing data arising from use of the website, its content, or public tools. The exclusion of data-restoration costs applies whether those costs are direct or indirect. Our total liability for claims under these Website Terms or arising from that use will not exceed $100.

These limitations apply regardless of the legal basis of a claim, including contract or ordinary negligence. They do not exclude or limit liability for fraud, gross negligence, willful misconduct, or anything that cannot lawfully be excluded or limited. They do not reduce rights under a separate platform, product, or professional services agreement. Mandatory consumer protections remain unaffected.

Agreement and updates

Where acceptance of these Terms is requested for a website feature, a user’s acceptance forms an agreement with Neon Deer. Merely visiting a page does not by itself establish agreement to contractual limitations. Copyright and other applicable laws protect our content independently of contractual acceptance.

We will publish revisions with an updated date. Revisions do not apply retroactively to claims that have already arisen. Where an existing agreement requires a user’s acceptance of revised terms, posting alone does not replace that acceptance.

Governing law

Where these Terms form an agreement, Washington law governs, excluding its conflict-of-laws rules. Unless mandatory law requires otherwise, disputes must be brought in the state courts in Spokane County, Washington, or the United States District Court for the Eastern District of Washington. Nothing here removes protections or access to courts that applicable law does not allow a person to waive.

If a provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver.
